1.1. This document “Terms and Conditions for Online Parking Reservations” and the document “Parking Terms and Conditions” (Einstellbedingungen) in their applicable version are part of the Parking Space Usage Contract (Stellplatznutzungsvertrag). The “Terms and Conditions for Online Parking Reservations” and the “Parking Terms and Conditions” are available at www.salzburg-airport.com/en/parking/general-parking-information, at the entrances of our parking areas and at the “Info-Center” in the departure hall. They are valid for the formation of a Parking Space Usage Contract with Salzburger Flughafen GmbH (“SFG”) and for conduct in the garage areas and on the parking lots (“parking area”). The “Parking Terms and Conditions” encompass general provisions for the Parking Space Usage Contract (e.g., liability provisions, maximum parking duration, video recordings, license plate recognition, regulations, fire emergency procedures). Additionally, this document “Terms and Conditions for Online Parking Reservations” encompasses provisions for parking spaces reserved online via www.salzburg-airport.com/en/parking/general-parking-information. In case of contradictions between the two documents “Terms and Conditions for Online Parking Reservations” and the “Parking Terms and Conditions”, the “Terms and Conditions for Online Parking Reservations” shall prevail.
1.2. By forming the Parking Space Usage Contract (see Section 2), the Customer (“User”) accepts this document “Terms and Conditions for Online Parking Reservations” and the “Parking Terms and Conditions” (see Section 1.1) and agrees to comply with them.
1.3. Information on the processing of your personal data related to parking is available at the entrances to our parking areas in the document “Privacy Notice for Parking” (Datenschutzmitteilung für das Parken), in Section 19 of our website’s Privacy Policy at www.salzburg-airport.com/en/footer/legal/privacy-policy and at the “Info-Center” in the departure hall.
1.4. The subcontractor that executes the contract is Carport Parkmanagement GmbH, Innsbrucker Bundesstraße 95, 5020 Salzburg.
1.5. Please duly note the following sections of the “Parking Terms and Conditions” (see Section 1.1): Section 3 (Liability provisions), Section 11.5 (Exclusion from liability), Section 13 (Video recordings) and Section 14 (License plate recognition).
2.1. Booking a parking space is possible up to 12 hours prior to the planned start of the parking period.
2.2. The provision of an online booking system is not per se a legally binding offer by SFG. It is merely a non-binding invitation to the User to submit an offer on the formation of a Parking Space Usage Contract in accordance with this document “Terms and Conditions for Online Parking Reservations”.
2.3. By pressing or clicking the “Pay” button, the User submits a binding and irrevocable offer to form a Parking Space Usage Contract.
2.4. Acceptance of the offer is confirmed when SFG sends a booking confirmation or when a booking confirmation is made available for the User to download, by whichever event occurs first. The booking confirmation is sent electronically immediately after submission of the offer. Approximately at the same time, the User is also enabled to download the booking confirmation themself. The Contract is effectively formed as soon as SFG has sent the booking confirmation or the User is enabled to download the booking confirmation, by whichever event occurs first (provided the events do not occur simultaneously).
2.5. By concluding a Parking Space Usage Contract, SFG commits to provide the User with a parking space. The specific parking area, the pre-defined parking duration (usage period) and the resulting parking fees (usage fees) are specified in the booking confirmation. However, the Customer has no claim whatsoever to the provision of a specific parking space (e.g., specific number, specific position) within the parking area specified in the booking confirmation.
2.6. The maximum usage period permitted is 42 days.
2.7. A subsequent change of the booking is not possible.
2.8. Bookings cannot be combined (e.g., in case of special offers). Only one booking is permitted per parking transaction.
2.9. Promotion codes must be entered into the “Promotion Code” field when booking (any relevant offers will be displayed).
2.10. For bookings up to EUR 400 (incl. sales tax), the booking confirmation shall be deemed to be an invoice of small amount (“Kleinbetragsrechnung”) pursuant to Article 11 par. 6 Austrian VAT Act (UStG).
The subject of this Contract is exclusively the provision of a parking space against payment according to the booking confirmation (see Section 2.5). The Contract does neither include safekeeping, surveillance or monitoring of the parked vehicle nor the provision of insurance coverage. This also applies when SFG staff members are present in the parking area or when the parking area is monitored by video surveillance.
The parking fee is due for payment by credit card immediately upon booking. The amount is identifiable on the User’s credit card statement with the payment reference “Salzburger Flughafen GmbH”. Prices displayed upon booking apply exclusively when booking in advance via the online booking system of SFG and apply exclusively to the booked period. SFG entrusts the payment service provider Payone GmbH (Lyoner Straße 9, 60528 Frankfurt/Main, Germany) with payment processing.
5.1. Booking cancellation or contract withdrawal are generally possible under the following conditions.
5.2. Contract withdrawal is possible within 14 days after contract formation (see Section 2.4) free of charge and without stating any reasons. To comply with the deadline, it is sufficient for the User to send a declaration to SFG before the end of the deadline. The User shall clearly state that they wish to withdraw from the Parking Space Usage Contract. The User may use SFG’s withdrawal form (available at www.salzburg-airport.com/en/parking/general-parking-information). The User may also submit an unequivocal declaration of withdrawal in another way (to Salzburger Flughafen GmbH, Innsbrucker Bundesstraße 95, 5020 Salzburg, info@salzburg-airport.at, phone: 0662 8580 7911).
5.3. After expiry of the 14-day period, withdrawal from the contract is possible up to 24 hours before the start of the parking period. SFG is entitled to collect cancellation fees from the User in accordance with the applicable parking fees. If expressly announced, special offers are excluded from cancellation after the expiry of the 14-day period up to 24 hours before the start of the parking period.
5.4. Less than 24 hours before the start of the parking period, cancellations are not possible anymore and the full parking fee will be charged.
5.5. In the event of withdrawal according to Section 5.2 and 5.3, the previously paid fee shall be refunded to the Customer in the same form as the payment was made. In the event of withdrawal according to Section 5.3, the refund shall be made less the cancellation fee according to the applicable parking fees and less any other costs incurred by SFG in connection with the withdrawal.
6.1. Upon entry into the parking area, the User must present the barcode printed on the booking confirmation to the barcode scanner. Subsequently, the User receives a parking ticket at the entry column. When entering the parking area by using the barcode within the booked time slot (or max. two hours prior), the entry column automatically recognises the online reservation, releases a ticket, and opens the entry barrier.
6.2. Only in the event that the barcode cannot be read, the User must pull a ticket.
6.3. If the User pulls a parking ticket by mistake upon entry without authorising themselves with the barcode, they must leave the parking area immediately and enter again by using the barcode. (The parking area can be exited free of charge within 10 minutes.) According to SFG, the owner of the parking ticket is authorised to use a free parking space. SFG is entitled, but not obliged to verify this authorisation.
6.4. The booking confirmation is only valid for a one-time entrance and one-time exit of the parking area.
7.1. After insertion of the parking ticket at the exit column and withdrawal of the ticket, the exit barrier is opened. The exit column recognises the parking ticket until the end of the booking period.
7.2. Additional payments at automatic pay stations or at checkout cashiers authorised for this purpose are only to be made if the parking time exceeds the booked period. The fee for the additional parking time is calculated on the basis of applicable parking fees. By pressing the receipt button, you may receive a receipt at the automatic pay station.
7.3. Exiting before the end of the booking period does not entitle to any refund.
8.1. If the User does not remove their vehicle from the parking area after expiry of the parking period agreed in the booking confirmation, an additional usage fee in the amount of the parking fees posted at the notice board shall be due for the excess time.
8.2. This additional usage fee is due for payment before removal of the vehicle.
8.3. Express reference is made to Section 6 of the “Parking Terms and Conditions” (maximum parking duration, removal of the vehicle).
9.1. Place of performance, place of jurisdiction and applicable law
Place of performance is the city of Salzburg. Unless mandatory by law, the exclusive place of jurisdiction for all disputes arising from or in connection with the parking space usage contract including the “Terms and Conditions for Online Parking Reservations”, the “Parking Terms and Conditions” (www.salzburg-airport.com/en/parking/general-parking-information) and any other applicable contractual terms and conditions shall be the court having subject-matter jurisdiction for the city of Salzburg, zip code 5020, Austria.
All legal disputes arising from or in connection with the Parking Space Usage Contract, including the “Terms and Conditions for Online Parking Reservations”, the “Parking Terms and Conditions” (www.salzburg-airport.com/en/parking/general-parking-information) and any other applicable contractual conditions, shall be governed exclusively by Austrian law, to the exclusion of all conflict of law provisions and the UN Convention on Contracts for the International Sale of Goods and the Rome I Regulation.
9.2. Severability clause
Should one of the provisions be invalid, this shall not affect the validity of all other provisions of these “Terms and Conditions for Online Parking Reservations”. Any invalid provision shall be replaced by a permissible provision that comes as close as possible to the economic purpose of the original provision.
9.3. Binding language version and translations
“Terms and Conditions for Online Parking Reservations” are conceived in German, which is binding for all matters related to these. Any other language version merely serves ease of understanding. In the event of contradictions, the German language version shall prevail.
9.4. Changes to “Terms and Conditions for Online Parking Reservations”
SFG is entitled to amend “Terms and Conditions for Online Parking Reservations” at any time. Amendments shall take effect to the User upon notice posting, online posting or publication of an amended version of “Terms and Conditions for Online Parking Reservations” (one of the three aforementioned possibilities shall suffice).
In case of any misunderstandings, contradictions or legal disputes resulting from these Terms and Conditions, the German language version of this Document shall prevail.
